While I agree with the ACLU about 95% of the time, your stance on the death penalty should be re-examined. As you know, the Constitution expressly permits capital punishment so it is not a violation of a constitutional right. Also, People have time and time again voted to uphold and support the death penalty, even here in California it finds wide support. The ACLU, therefore, ought to focus its energies on ensuring the due process rights of those charged with capital crimes are diligently protected.
