The problem here is attempting to frame an issue in regards to current laws. There is no Federal Law or Constitutional statement regarding gender identity. In fact, from a Constitutional standpoint, only the biological binary system of male and female are listed and given equal rights. While those rights appear as appropriate by extension of basic constitutional rights, the fact is they are spelled out in further amendments and laws. Frankly, this is where changes should occur. Fighting for more administrative rules and regulations don’t change the law. In fact, it allows the Uss John S Mccain Big Bad John Shirt, specifically the POTUS in most situations, to simply remove the rule with a few pen strokes. The simple fact is that gender identity isn’t addressed and it clearly needs to be. Not with basing it on certain states labor laws but rather getting legislation passed addressing the issue. You too cannot change the law just because you are prejudice.
Actually, “gender identity” is NOT a new concept, nor does everyone accept two genders.
First, “gender” is not sex, nor is sex gender. There are many men who are feminine, and many women who are masculine.
As an example, I had a great aunt who looked and acted like a man. She broke horses, led hunting expeditions in Colorado, often running her male guests into the ground. She actually chased a black bear in her PJs one night that was roaming around one of the cabins she rented in the Uss John S Mccain Big Bad John Shirt. She was the toughest S.O.B. I’ve ever met. Biologically, she was female. Yet, she was masculine in nature. Some Native American tribes recognize at least three genders. In fact, there are cultures all around the world where a third gender is celebrated. So the argument that there are only two genders is spurious and invalid. Our culture, at this time, is transitioning from recognizing more than two genders. It will take time for it to become the norm. Sadly, yes, laws will have to change. It’s not unlike the Civil Rights act in 1967, or laws that make it illegal to treat women differently in the workplace — or people of different races marrying. Remember, our government and way of life is based on everyone being equal, with the basic rights of being able to have the freedom to live in such a way that we’re happy, so long as my rights do not infringe on yours.

I wonder what position the ACLU holds on bakers that refuse to decorate cakes for same-sex weddings, Christian photographers and Christian owned venues that refuse to service Same-sex weddings. It’s not like you have to wonder. The ACLU has consistently supported the rights of clergy (not that anyone has attempted to force a minister to perform a religious service) to act according to their doctrine. There’s also no question that churches do not have to allow services of any sort that do not conform to their doctrine. But a business that is open to the public is a different matter. If you’re open to the public, then you have to serve the entire public. You don’t get to say, “I’m open for business unless I don’t like who you’re marrying.”
